SUBTITLE F. MUNICIPAL UTILITY DISTRICTS


CHAPTER 8165. CHATEAU WOODS MUNICIPAL UTILITY DISTRICT


SUBCHAPTER A. GENERAL PROVISIONS


Sec. 8165.001. DEFINITIONS. In this chapter:

(1) "Board" means the board of directors of the district.

(2) "City" means the city of Chateau Woods.

(3) "District" means the Chateau Woods Municipal Utility District.

Sec. 8165.002. NATURE OF DISTRICT. The district is a conservation and reclamation district in Montgomery County created under Section 59, Article XVI, Texas Constitution.

Sec. 8165.003. FINDINGS OF BENEFIT AND PUBLIC PURPOSE. (a) The district is created to serve a public use and benefit.

(b) All land and other property included in the district will benefit from the works and projects accomplished by the district under the powers conferred by Section 59, Article XVI, Texas Constitution.

(c) The district is essential to accomplish the purposes of Section 59, Article XVI, Texas Constitution.

Sec. 8165.004. DISTRICT TERRITORY. The district is composed of the territory described by Section 3, Chapter 744, Acts of the 73rd Legislature, Regular Session, 1993, as that territory may have been modified under:

(1) Subchapter H, Chapter 54, Water Code;

(2) Subchapter J, Chapter 49, Water Code; or

(3) other law.

SUBCHAPTER B. BOARD OF DIRECTORS


Sec. 8165.051. COMPOSITION OF BOARD; TERMS. (a) The district is governed by a board of five directors.

(b) Directors serve staggered four-year terms.

Sec. 8165.052. QUALIFICATIONS FOR OFFICE. To be eligible to serve as director, a person must:

(1) be a registered voter; and

(2) reside in the district.

Sec. 8165.053. VACANCIES. A vacancy in the office of director shall be filled by appointment of the board until the next election for directors. If the position is not scheduled to be filled at the election, the person elected to fill the position shall serve only for the remainder of the unexpired term.

SUBCHAPTER C. POWERS AND DUTIES


Sec. 8165.101. MUNICIPAL UTILITY DISTRICT POWERS. The district has the rights, powers, privileges, functions, and duties provided by general law applicable to a municipal utility district created under Section 59, Article XVI, Texas Constitution, including those conferred by Chapters 49, 50, and 54, Water Code.
